yet. made possible by honda. >>> the judge presiding over the conduct of john leopold dismissed one of the charges against him. he says it's because the state has not met its burden of proof. fox 5's paul wagner has the latest. >> reporter: the judge's decision to throw out count to of the indictment has to do with an allegation john leopold was seen on at least six occasions by his police security detail throwing out the campaign signs of his political rival. the judge said in his view leopold was acting as a private citizen, and it did not rise to malfeasance in office. the day began with defense attorney passionately arguing his client's case telling judge sweeney over a good part of the morning the common law crimes john leopold is accused of are constitutionally vague. he used a tv vane to make his point telling the judge, the police are the criminal law experts and where was the chief in all of this? several police officers testified under immunity that they complained to the chief of police about leopold's demands, but nothing was done and there was no, as one officer put it,
